UNDERTAKINGS

An undertaking is a promise to the Court that is entered into by the parties for the Person Bound to comply with specific conditions which usually mirror their interim FVRO conditions.

Undertakings are used to ‘settle out of court’ rather than going through a Trial.

Both parties must reach an agreement to enter into a Undertaking and when doing so agree that the current interim FVRO application made previously by the Person Protected is dismissed.

Undertakings are recorded on the Court file but are not a court order and are not enforceable by the police or the Courts.
